Welcome to JSCart (“we”, “our”, “us”). • By selecting a subscription plan, you agree to pay the applicable fees for that plan. You may upgrade, downgrade, or cancel your subscription according to the terms outlined in your agreement with us.
• Payments are processed through third-party payment processors, and you agree to comply with their terms and conditions as well.

5. Billing and Payments

• Payments for subscription plans will be billed on a recurring basis (e.g., monthly, annually), depending on the plan you select.
• You agree to provide accurate billing information and promptly update your payment details if necessary.
• You acknowledge that failure to pay your subscription fees may result in suspension or termination of your account and access to Services.

6. User Content

• You retain ownership of all content, data, and materials you upload to the platform (“User Content”), but you grant JSCart a license to use, display, and process your User Content as necessary to provide the Services.
• You are responsible for ensuring that your User Content does not infringe any third-party intellectual property rights or violate any laws.

7. Acceptable Use Policy

• You agree not to use the Services for any unlawful purpose or in a manner that could harm, disable, or overload the platform.
• You may not upload or distribute viruses, malware, or any other harmful content.

8. Termination

• Either party may terminate the agreement at any time with notice to the other party.
• You may terminate your subscription at any time through your account settings or by contacting our support team.
• We may suspend or terminate your account if you violate these Terms or engage in any activity that threatens the integrity of the platform.

9. Refunds and Cancellations

• Subscriptions are billed in advance and are non-refundable unless otherwise stated.
• If you cancel your subscription, you will continue to have access to the platform until the end of your billing cycle, but you will not receive a refund for the remaining period.

10. Privacy and Data Protection

We respect your privacy and are committed to protecting your personal data. By using our Services, you consent to our Privacy Policy, which outlines how we collect, use, and protect your data. We may process personal data in accordance with applicable data protection laws, including GDPR (if applicable).

11. Intellectual Property

JSCart and all related content, logos, trademarks, and software are the property of VERSEOI Sp. z o.o. or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the platform for its intended purpose. This license does not grant you any ownership rights in the platform or its content.

12. Limitation of Liability

• To the maximum extent permitted by law, JSCart is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the platform.
• Our liability for any claim related to the Services will be limited to the amount you have paid for the Services during the three (3) months preceding the claim.

13. Indemnification

You agree to indemnify and hold JSCart, its affiliates, officers, and employees harmless from any claims, losses, or damages arising from your use of the Services, including any violation of these Terms.

14. Modifications to the Terms

We may update or modify these Terms at any time, and the revised version will be effective immediately upon posting. We will notify you of any material changes. Your continued use of the Services after any changes to these Terms constitutes your acceptance of the modified Terms.

15. Governing Law

These Terms will be governed by and construed in accordance with the laws of Poland. Any disputes will be resolved in the courts of Poland, unless alternative dispute resolution methods are agreed upon.

16. Miscellaneous

These Terms, along with the Privacy Policy and any other policies or agreements you enter into with JSCart, constitute the entire agreement between you and us. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
